GOODJOB TERMS OF SERVICE

Welcome to GoodJob. These Terms of Service (“Terms”) govern your access to and use of the GoodJob platform (“Platform”). By accessing or using the Platform, you agree to be legally bound by these Terms and our Privacy Policy.

If you do not agree, you must immediately discontinue use of the Platform.


1. NATURE OF THE PLATFORM

GoodJob is a technology-based marketplace platform that connects independent service providers (“Providers”) with customers (“Clients”).

  • GoodJob is not a service provider
  • GoodJob does not employ or control Providers
  • GoodJob does not guarantee service quality, safety, or outcomes

All services are performed at the sole discretion and responsibility of the Provider.


2. USER ELIGIBILITY AND CLASSIFICATION

Users may register as:

  • Client
  • Provider
  • Dual User

Users agree to comply with all obligations applicable to their selected role(s).


3. ACCOUNT REGISTRATION AND VERIFICATION

GoodJob may require:

  • Accurate personal information
  • Government-issued identification
  • Identity verification (KYC)

GoodJob reserves the right to:

  • Approve or deny registration
  • Suspend accounts pending verification
  • Permanently terminate accounts for false or misleading information

All personal data is processed in accordance with the Privacy Policy.


4. USE OF PERSONAL DATA

By using the Platform, you consent to the collection and processing of your personal data for:

  • Service facilitation
  • Identity verification
  • Payment processing
  • Fraud prevention
  • Legal compliance

5. PAYMENT SYSTEM AND ESCROW

All payments must be processed exclusively through the Platform.

Standard Flow:

  1. Client pays funds held in escrow
  2. Provider performs service
  3. Client confirms payment released

Escrow Edge Cases (CRITICAL FOR PROTECTION):

A. Client No-Show

  • Provider may submit proof (photos, chat logs, timestamp)
  • Platform may release partial or full payment to Provider

B. Provider No-Show

  • Full refund to Client
  • Provider may face penalties or suspension

C. Partial Completion

  • Platform may release pro-rated payment based on completed work

D. Service Dispute

  • Funds are temporarily frozen
  • Platform evaluates evidence and decides final distribution

E. Fraudulent Claims

  • Platform may override claims and impose penalties

All escrow decisions made by GoodJob are final and binding.


6. PLATFORM FEES, COMMISSIONS, AND RECOVERY

GoodJob may charge:

  • Service fees
  • Provider commissions

All fees are disclosed prior to payment.


Anti-Bypass Fee Recovery Mechanism (HIGHLY IMPORTANT):

If users attempt to bypass the platform:

  • GoodJob may charge a penalty fee equivalent to 15%–30% of the estimated transaction value, or
  • A fixed penalty amount determined by the Platform

Additional actions may include:

  • Permanent account ban
  • Withholding of funds
  • Legal enforcement of damages

7. STRICT PROHIBITION ON OFF-PLATFORM TRANSACTIONS

Users are strictly prohibited from:

  • Sharing contact details to transact outside the platform
  • Completing bookings outside GoodJob after initial connection
  • Encouraging or coercing other users to bypass platform fees

Enforcement Methods:

  • Chat monitoring (automated keyword detection)
  • Behavior tracking
  • User reporting system

Violations will result in severe penalties.


8. CANCELLATIONS, REFUNDS, AND NO-SHOW POLICY

Client Cancellation:

  • Before Provider acceptance full refund
  • After Provider dispatch partial or no refund

Provider Cancellation:

  • May result in:
    • Ranking downgrade
    • Temporary suspension
    • Financial penalties

No-Show Rules:

  • Client no-show Provider compensation possible
  • Provider no-show Client refund + Provider penalty

9. DISPUTE RESOLUTION SYSTEM

Process:

  1. Submission of evidence (photos, chat, timestamps)
  2. Platform review and mediation
  3. Final binding decision

GoodJob may:

  • Release or refund funds
  • Split payments proportionally
  • Penalize either party

10. RATING, RANKING, AND ALGORITHM CONTROL

GoodJob uses internal systems to rank Providers based on:

  • Ratings and reviews
  • Completion rate
  • Cancellation rate
  • Response time
  • Platform compliance

Important Clause:

  • Rankings are fully controlled by GoodJob algorithms
  • Rankings may be adjusted, reduced, or removed at any time
  • Violations (especially bypass attempts) may result in shadow banning or visibility reduction

This ensures platform quality and fairness.


11. FRAUD, MISCONDUCT, AND SAFETY VIOLATIONS

Strictly prohibited:

  • Fake bookings
  • Identity fraud
  • Harassment or unsafe behavior
  • Theft or property damage
  • Overcharging beyond agreed terms

Penalties:

  • Immediate account ban
  • Forfeiture of funds
  • Reporting to authorities

12. DATA PROTECTION AND RETENTION

GoodJob processes and protects data in accordance with its Privacy Policy and applicable laws.

Key Retention Rules:

  • Active accounts retained during use
  • Inactive accounts deleted after 2 years + 30-day notice
  • User deletion requests processed within 30 days (if through email) or immediately (by user through the platform)
  • Financial/fraud data retained up to 5 years

13. LIMITATION OF LIABILITY

To the fullest extent permitted by law, GoodJob shall not be liable for:

  • Personal injury, death, or damages
  • Loss of property or income
  • Service dissatisfaction
  • Provider or Client misconduct
  • Off-platform agreements or interactions

GoodJob acts solely as an intermediary platform.


14. ASSUMPTION OF RISK

Users acknowledge and agree that:

  • Engaging with other users involves inherent risks
  • They are solely responsible for their decisions and interactions
  • GoodJob does not conduct full background checks unless explicitly stated

15. INDEMNIFICATION

Users agree to indemnify and hold GoodJob harmless from:

  • Claims
  • Damages
  • Legal costs

Arising from:

  • Use of the Platform
  • Violation of these Terms
  • Breach of laws or third-party rights

16. TERMINATION AND ENFORCEMENT

GoodJob may suspend or terminate accounts:

  • For violations
  • For suspected fraud
  • To protect platform integrity

Termination may occur without prior notice in high-risk situations.


17. GOVERNING LAW

These Terms are governed by the laws of the Republic of the Philippines.


18. MODIFICATIONS

GoodJob reserves the right to modify these Terms at any time. Continued use constitutes acceptance.
